1. Provision of Services

1.1 The Customer warrants that it has obtained the relevant approval and consent of the Examinee for:

  • Themis Medico-Legal providing any of the Services to that Examinee; and
  • Themis Medico-Legal providing a copy of any report in respect of the Examinee to the Customer or any person nominated by the Customer.

1.2 Where the Customer or Examinee does not provide the relevant documentation to Themis Medico-Legal at least five (5) business days in advance of the scheduled appointment, Themis Medico-Legal reserves the right to cancel the scheduled appointment. Cancellation Fees may apply.

1.3 Where the Examinee or the Customer does not provide reasonable assistance to enable the provision of those Services, the Customer remains liable to pay any Fees relating to those Services.

1.4 The Customer acknowledges that any medico-legal report or related advice is provided on an ‘as is’ basis and may be based partly on information provided by the Customer and/or the Examinee. Themis Medico-Legal is not responsible for any incorrect, incomplete, or false information provided to our experts that results in an unsatisfactory conclusion.

1.5 Expert witness services — The Customer will be provided with the Fees and the Terms and Conditions upon confirmation of the booking.

2. Fees and Payment

2.1 The Customer will:

  • Pay all Fees within fourteen (14) days from the relevant invoice date, unless alternative payment terms have been negotiated;
  • Pay any required Fees in advance if requested by Themis Medico-Legal;
  • Pay Cancellation Fees if any of the following occur:
    • The Customer or Examinee cancels a consultation within five (5) business days prior to the appointment;
    • The Customer or Examinee fails to submit required paperwork (letter of instruction and file material) at least five (5) business days prior to the appointment;
    • The Examinee fails to attend the appointment.
  • Pay any “Failure to Attend” Fee if the Examinee does not attend or is more than 10 minutes late to the scheduled appointment;
  • Pay additional Fees for:
    • Assessment of multiple body systems or conditions;
    • Extensive file materials;
    • Complex matters (including with an allied health professional, interpreter assisted examination, medical negligence, professional indemnity, and personal injury claims involving mental or physical injuries caused by violence, abuse, or criminal acts).

2.2 Quotes for additional Fees will be provided upon request.

3. Limitation of Liability

3.1 To the extent permitted by law, Themis Medico-Legal’s total liability to the Customer is limited to the Fees paid for the Services or the cost of their rectification or resupply, whichever Themis Medico-Legal determines.

4. Website Use and Intellectual Property

4.1 All content on Themis Medico-Legal’s website — including text, graphics, logos, photographs, and resources — is protected by copyright and other intellectual property laws.

4.2 You may view, download, and print material from the website for personal, non-commercial use only.

4.3 You must not copy, reproduce, modify, distribute, display, or exploit any content without our prior written consent.

5. No Legal or Medical Advice

5.1 While Themis Medico-Legal provides professional medico-legal services — including independent assessments, expert opinions, and legally sound reports — nothing on this website or in our marketing materials constitutes personal legal representation or medical treatment. Our assessments are conducted for medico-legal purposes only, not for ongoing patient care or case advocacy.

5.2 You should seek independent legal or medical advice before acting on any information from Themis Medico-Legal.

6. Privacy

6.1 Themis Medico-Legal handles all personal information in accordance with our Privacy Policy.

7. Governing Law

7.1 These Terms are governed by the laws of Queensland, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Queensland.

8. Agreement

8.1 By engaging Themis Medico-Legal’s Services or using our website, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

9. Definitions

  • Customer: A law firm, insurer, or other entity engaging Themis Medico-Legal’s Services.
  • Examinee: An individual on whose behalf the Customer engages Themis Medico-Legal’s Services.
  • Services: Services means any and all professional medico-legal services provided by Themis Medico-Legal to the Customer, including but not limited to: independent medico-legal assessments; expert opinions; expert witness services; medico-legal reports; capacity assessments; supplementary reports; file reviews; and related professional services as described on our website. These services are delivered by qualified medical and occupational experts, supported by in-house legal quality assurance.

Fees: The fees payable for the provision of the Services, including applicable cancellation and failure-to-attend fees.
